Welcome to our web3 platform, Vape2Earn. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the platform.
2. Definitions
Platform: Refers to the PUFFIN Vape2Earn web3 application.
User: Any individual or entity accessing or using the platform.
Tokens: Digital assets ($PFFN) available for presale and use within the Vape2Earn ecosystem and Platform.
3. Acceptance of Terms
By using our platform, you agree to these Terms. We reserve the right to modify these Terms at any time without prior notice. Your continued use of the platform constitutes your acceptance of the revised Terms.
4. Use of the Platform
The platform is provided "as is" and "as available" without warranties of any kind.
Users are responsible for ensuring that their use of the platform complies with all applicable laws and regulations.
5. Limitation of Liability
The developers and the company behind Vape2Earn shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the platform.
The company does not guarantee the accuracy, completeness, or usefulness of any information on the platform and does not adopt nor endorse, nor is it responsible for, the accuracy or reliability of any opinion, advice, or statement made by parties other than the company.
6. Indemnification
Users agree to indemnify and hold harmless the developers and the company from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of or related to their use of the platform.
7. Token Presale
No Refunds: All token sales during the presale are final. No refunds will be issued under any circumstances.
Use of Funds: The company reserves the right to use the funds raised from the token presale at its sole discretion. This may include, but is not limited to, platform development, marketing, operational expenses, or any other purpose the company deems necessary.
No Guarantee: The purchase of tokens does not guarantee any form of profit or return on investment. Users acknowledge that the value of tokens may fluctuate and that there is no assurance of any specific outcome.
8. Intellectual Property
All intellectual property rights in the platform, including but not limited to software, design, text, and graphics, are owned by or licensed to the company. Users are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the company is established, without regard to its conflict of law principles.
10. Vape Products Disclaimer

By purchasing or using our vape products, users acknowledge and understand that smoking or vaping can be harmful to their health. The use of any vaping products, including those produced by our company, carries inherent risks. Users assume all responsibility for any adverse effects that may result from using our products.
10.2 Limitation of Liability
The company and its developers shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or misuse of our vape products. This includes, but is not limited to, any injuries, health issues, or death caused by vaping or the use of our smoking liquids.
Users agree that the company is not responsible for any damage or injury caused by improper use, abuse, or modification of the vape products or smoking liquids.

10.5 Age Restrictions
Our vape products are intended for use by adults of legal smoking age only. By purchasing or using our products, users confirm that they are of legal age in their jurisdiction.
The company does not condone or support the use of vaping products by minors and takes steps to prevent the sale of our products to underage individuals.
11. Prohibited Jurisdictions
11.1 Eligibility
Participant is only allowed to purchase $PFFN Tokens if by buying Tokens he/she/it covenants, represents, and warrants that they are neither a citizen, resident, nor tax resident (hereinafter also can be jointly referred to as the “Resident”) of the United States of America, (hereinafter referred to as the “U.S.” or U.S. Person), Bolivia, Cambodia, Canada, Central African Republic, China, Congo, Cuba, Democratic People’s Republic of Korea, Democratic Republic Congo, Libya, Syria, Iran, Iraq, Republic of Crimea, Yemen, Somalia, Sudan, South Sudan, and countries or territories or individuals under the sanctions of the United Nations or the European Union or OFAC or a resident of a territory with limited recognition (Prohibited Jurisdictions).
You also represent and warrant that You are not a citizen or resident of a geographic area in which access to or use of the cryptocurrency or Tokens, or where participation in ICO is prohibited by applicable law, decree, regulation, treaty, or administrative act. We shall reserve the right to refuse selling $PFFN Tokens to anyone who does not meet the criteria set forth above.
11.2 Representation and Warranty
Residents of the Prohibited Jurisdictions are not eligible and not allowed to participate in the $PFFN Token Sale due to various taxation and regulatory issues. In order to buy Tokens and by buying them Participant covenants, represents, and warrants that none of the owners of the company, of which Participant can be an authorized officer, are residents of the Prohibited Jurisdictions. Should this change at any time, Purchaser shall immediately notify the Company.
Purchaser also represents and warrants that he/she/it is not a citizen or resident of a geographic area in which access to or use of the cryptocurrency or cryptographic tokens is prohibited by applicable law, decree, regulation, treaty, or administrative act. Purchasers cannot resell $PFFN Tokens to citizens and residents of countries and territories restricted in this Agreement.
11.3 Limitation of Liability
THE COMPANY SHALL NOT BE HELD LIABLE FOR ANY LEGAL OR MONETARY CONSEQUENCE ARISING FROM BUYING $PFFN TOKENS BY RESIDENTS OF THE PROHIBITED JURISDICTIONS OR THEIR USE OF THE WEBSITE OR FROM TOKENS BEING RESOLD TO THEM. PURCHASERS REPRESENTATIONS AND GENERAL PROVISIONS.
12. Trading and Earning Disclaimer
The platform and all information provided on the platform do not constitute trading or earning advice. Users engage in any trading or earning activities at their own risk. The company is not responsible for any financial losses or damages incurred as a result of trading or earning activities conducted through the platform.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the company is established, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be resolved through arbitration in the company's jurisdiction.
14. Amendments
The company reserves the right to amend these Terms at any time. Users will be notified of any significant changes to these Terms through the platform. Continued use of the platform and our products after such changes constitutes acceptance of the new Terms.
